Terms of Use

By downloading, installing, or using ChallengeTies ("the App", "the Service"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms") and our Privacy Policy.

These Terms constitute a legally binding agreement between you ("User", "you") and Maxime Cortes, an individual operating ChallengeTies as a sole trader ("I", "me", "we"). ChallengeTies is an independent mobile application published on the Apple App Store and Google Play Store.

You must be at least 13 years of age to use ChallengeTies. If you are under 18, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

By using the App, you represent that you have the legal capacity to enter into this agreement and that your use complies with all laws applicable in your country of residence.

To access certain features you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Keep your password secure and confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately at support@challengeties.app of any unauthorized use

We reserve the right to refuse registration or terminate accounts at our sole discretion.

ChallengeTies offers free and premium features. Premium access is available via auto-renewing subscriptions and one-time purchases processed through Apple App Store or Google Play Store.

• All purchases are subject to the payment terms of the applicable platform
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
• You can manage and cancel subscriptions in your device account settings at any time
• We do not issue refunds for partially used subscription periods, except where required by applicable law
• Prices may vary by region and are subject to change with reasonable notice

ChallengeTies allows users to create challenges, usernames, and other content ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content solely in connection with operating the Service.

You represent that:

• You own or have the necessary rights to the content you submit
• Your content does not infringe any third-party rights
• Your content complies with these Terms and applicable law

We reserve the right to remove any User Content we deem inappropriate or in violation of these Terms. Users may report objectionable content directly within the App.

You agree not to use ChallengeTies to:

• Violate any applicable local, national, or international law or regulation
• Harass, bully, threaten, or abuse other users
• Post hateful, discriminatory, obscene, or defamatory content
• Impersonate any person or misrepresent your identity
• Collect other users' personal data without their consent
• Distribute spam, malware, or harmful software
• Attempt to gain unauthorized access to the Service or its infrastructure
• Reverse engineer or decompile any part of the App
• Use automated bots or scrapers to interact with the Service

Violations may result in immediate suspension or permanent termination of your account.

All content, features, and functionality of the App — including text, graphics, logos, icons, and software — are the property of Maxime Cortes / ChallengeTies or its licensors and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.

The "ChallengeTies" name and logo are trademarks of Maxime Cortes. Nothing in these Terms grants you any right to use them.

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or secure at all times. ChallengeTies is a habit-tracking tool — it is not a medical, therapeutic, or professional service of any kind.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAXIME CORTES / CHALLENGETIES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF YOUR USE OF, OR INABILITY TO USE, THE APP.

IN NO EVENT SHALL TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR EUR €100, WHICHEVER IS GREATER.

If you are a consumer resident in the European Union, nothing in these Terms limits your statutory rights under applicable EU consumer protection law.

You agree to defend and hold harmless Maxime Cortes / ChallengeTies from any claims, damages, costs, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or any content you submit through the App.

We may suspend or terminate your account at any time if we reasonably believe you have violated these Terms.

You may delete your account at any time from within the App (Settings → Delete Account) or by contacting us at support@challengeties.app. Upon deletion, your personal data will be handled in accordance with our Privacy Policy.

All provisions that by their nature should survive termination shall survive, including intellectual property rights, disclaimers, and limitations of liability.

These Terms are governed by and construed in accordance with the laws of France, without regard to conflict of law provisions.

Any dispute arising from these Terms shall first be attempted to be resolved informally by contacting us at support@challengeties.app. If unresolved within 30 days, disputes may be submitted to the competent courts of France.

If you are a consumer resident in the European Union, you also have the right to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

We may modify these Terms at any time. When we make material changes, we will update the "Last updated" date at the top of this page and notify you within the App or by email where appropriate.

Your continued use of ChallengeTies after changes take effect constitutes acceptance of the revised Terms. If you do not agree, you must stop using the App.
